Claim Duration Period

There is no easy and simple answer to the question of how long it takes to finalise a claim.  The reason for this is that the duration of a civil claim is dependent on many different factors, such as:

  • Collection of information, evidence and documentation necessary to prove the claim;
  • Obtaining of essential information and documentation in properly formulating the claim;
  • The management of the court roll in various jurisdictions.  Some High Court jurisdictions have waiting periods of two years or more, whereas others are able to enroll matters for trial within 6-12 months;
  • Exchange of pleadings.  Complex issues may be debated in the pleadings, leading to an extended period before a trial date may be applied for;
  • Postponements.  If a matter is not ripe for trial or if either party is not ready for trial, they may approach the other (or the court) for the trial to be postponed.  If the postponement is due to fault of one of the parties, costs may be tendered;
  • Availability of witnesses and experts.

It is important that you establish a good relationship with your attorney and that you communicate properly as to the reasons for any perceived delays.
